On Nov. 22, a Federal Judge in Texas issued an injunction putting the brakes on the new overtime rules, which were slated to take effect on Dec. 1.
The Department of Labor initially issued new guidance to the Fair Labor Standards Act back in May. The change would have affected nearly 4.2 million employees nationwide, changing them from exempt to non-exempt, and thus making them eligible for overtime.
However, with this injunction in place, employers DO NOT have to implement the changes on Dec. 1. President-elect Donald Trump has previously stated he has plans to make adjustments to the regulations the DOL originally issued in May, and should this injunction be in place when he takes office, employers may see another change to the regulations.
